Maxwell Radway is a fearless litigator with a focus on employment law, labour law, defamation law, professional regulation, and commercial litigation.
Maxwell practised law at the Toronto office of a large global law firm for several years, where he regularly acted on complex litigation, major transactions and cross-border matters. Maxwell then practised at a well-known boutique litigation firm, including as a partner, where he was regularly involved in high-stakes lawsuits covered in the national news.
Having appeared before various courts, tribunals and boards, Maxwell understands that an effective litigation strategy must be adapted to the client’s specific circumstances. Whether his client prefers early settlement or hard-fought litigation, Maxwell has the experience to pursue excellent results.
Maxwell’s work as an employment lawyer includes wrongful dismissal, constructive dismissal, harassment/sexual harassment, employment standards, disability benefits, workers’ compensation and occupational health and safety. He also regularly advises on employment contracts, employee terminations, and workplace policies, in addition to conducting workplace investigations.
Maxwell’s work as a labour lawyer focuses on grievance arbitration and also includes advising on workplace policies and collective agreement matters. He uses a proactive approach to ensure that employers are free to organize their workplace in a safe, efficient and cost-effective manner.
Maxwell also has considerable experience as a human rights lawyer. He updated The Duty to Accommodate in Employment, a human rights textbook consulted by lawyers across Canada.
Maxwell has represented clients in high-profile defamation matters that have made national news, including matters involving allegations of professional misconduct, discrimination, and harassment, as well as matters raising issues related to freedom of expression and academic freedom.
When it comes to professional regulation, Maxwell understands that it is not only a client's reputation at stake but also their livelihood. Maxwell encourages early intervention to prevent foreseeable issues and to avoid regulatory pitfalls. When a regulatory complaint or an accusation of professional misconduct or professional incompetence has been made, Maxwell's approach is to address the accusations directly and fearlessly, by establishing an evidentiary record consistent with the letter and purpose of the relevant legislation, regulation and/or code of conduct.
Maxwell also offers representation in a variety of commercial litigation and general litigation matters, including contract litigation, commercial arbitration, shareholder disputes, partnership disputes, product liability, class actions, and securities litigation.
Maxwell completed his legal education at Queen’s University Faculty of Law. While in law school, Maxwell participated in a number of advocacy competitions, including representing his law faculty internationally at the prestigious Willem C. Vis International Commercial Arbitration Moot in Vienna, Austria. Maxwell also twice served as president of the Queen’s Law Litigation Society and provided legal services to the community with both Queen’s Legal Aid and the Queen’s Business Law Clinic.
